These Terms of Use and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United Kingdom.
These Purchase Terms (the "Purchase Terms") govern your purchases of products and services available through http://www.vividhappiness.com (the "Company Sites" or the "Sites"). Your use of the Company Sites and these terms is also subject to the Terms of Use and the Privacy Policy, which are incorporated herein by reference.
PLEASE READ THESE PURCHASE TERMS CAREFULLY—TOGETHER WITH THE TERMS OF USE, THE PRIVACY POLICY, AND ANY OTHER POLICIES OR AGREEMENTS REFERENCED IN THESE PURCHASE TERMS—BEFORE MAKING A PURCHASE. BY PURCHASING OR USING PRODUCTS OR SERVICES VIA THE COMPANY SITES, YOU AGREE TO THESE PURCHASE TERMS, INCLUDING, WITHOUT LIMITATION, THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER DESCRIBED IN THE DISPUTE RESOLUTION SECTION BELOW.
### GENERAL
These Purchase Terms have been executed and submitted by you and constitute a valid and binding agreement between you and the Company, enforceable against you in accordance with its provisions. You represent that you are (1) at least 18 years of age, (2) of legal age to enter into a binding contract, and (3) not a person barred from receiving services under any applicable laws, regulations, or statutes.
You agree to purchase and use the products and services available through the Company Sites in strict compliance with these Purchase Terms and all applicable laws, regulations, and statutes (collectively, "Laws"). You are responsible for compliance with all Laws regarding your purchase, including all Laws within the jurisdiction to which the products are shipped.
### PRIVACY POLICY
A copy of the Privacy Policy governing the collection, use, disclosure, and other processing of personal information by the Company can be found at http://www.vividhappiness.com. Personal information provided by you (via the Company Sites, email, telephone, or otherwise) will be collected, stored, and otherwise processed in accordance with the provisions of the Privacy Policy. The Company may update the Privacy Policy at its sole discretion. Changes to our Privacy Policy will be posted at http://www.vividhappiness.com. By using the Company Sites, you acknowledge and accept the Privacy Policy.
#### Order Processing
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Kingdom.
The Company may, at its sole discretion, decide not to process or to cancel your order under certain circumstances. This may occur, for example, if the product or service you wish to purchase is out of stock or mispriced, if we suspect the request is fraudulent, or in other circumstances that the Company deems appropriate in its sole discretion. The Company also reserves the right, at its sole discretion, to take measures to verify your identity in order to process your order. The Company will either not charge you any fees or will refund the fees for orders that we do not process or that we cancel. Notwithstanding the foregoing, the Company reserves the right to: (i) revoke any stated offer; (ii) correct errors, inaccuracies, or omissions; and (iii) make changes to prices, content, promotional offers, product descriptions or specifications, or other information, without any obligation to issue notice of such changes (including after an order has been submitted, confirmed, shipped, or received, unless prohibited by law).
#### Product and Service Descriptions
The Company strives to provide accurate descriptions of products and services on the Company Sites. However, the Company does not warrant that the descriptions are accurate, complete, reliable, current, or error-free. If a product or service offered on the Company Sites is not as described, your sole remedy is to return the item, as specified in these Terms of Purchase.
The Company Sites may offer a "Quick View" feature for various products. This feature allows you to view pricing information for a product and add the product to your shopping cart without opening the full product page. The Quick View feature and this "Add to Cart" functionality are offered solely for your convenience. You will find more detailed information regarding a product—including its source, features, and pricing—on the dedicated product page.
#### Pricing
The Company strives to provide accurate pricing information for the products and services available on the Company Sites. However, we cannot guarantee that pricing will be free of errors. The Company reserves the right, at its sole discretion, to refuse to process or to cancel any orders placed for a product or service for which the price was listed incorrectly due to an error. Should this occur, the Company will notify you via email. Furthermore, the Company reserves the right, at its sole discretion, to correct any errors in the listed regular retail price.
#### Product and Service Availability
The Company Sites may contain information regarding product availability. This information may be used to estimate the likelihood that an item will ship immediately after you place your order. The estimated delivery date to your destination address for an item is typically within approximately 30 days or less following your successful payment; however, this may vary depending on item availability, adverse weather conditions, transit times with your shipping carrier, your destination address, and other factors. Unfortunately, the Company cannot guarantee that an item listed as "in stock" will actually be shipped immediately, as inventory levels can fluctuate significantly from day to day. In rare instances, a product or service may be available at the time a customer places an order but be sold out by the time the Company attempts to process that order. Should this occur, the Company will notify you via email. Services that are out of stock are generally no longer available. If the Company determines that a product or service you wish to purchase is no longer available, the item will be cancelled from your order. The Company will notify you via email and remove the item from its website.
#### Specific Additional Disclaimers and Obligations
In addition to the general disclaimers set forth in the Terms of Use regarding products and services purchased through the Site, the following applies to products and services purchased on the Site: (a) they may not include any manufacturer warranties, even if a specific product or service is available elsewhere with such a warranty; (b) they may not include any service or support options; (c) they may not include product manuals, instructions, or safety warnings in your native language or in some of the national languages of the destination country; (d) they may not be designed in accordance with the standards, specifications, and labeling requirements of your jurisdiction; and (e) they may not conform to the voltage and other electrical standards of your jurisdiction (which may require the use of an adapter or converter). It is your responsibility—and you hereby agree—to research the product to ensure that it meets your requirements and that it can be lawfully imported into your jurisdiction.
#### Taxes
You are responsible for all taxes, customs duties, and fees levied by the jurisdiction to which the products are shipped, including, but not limited to, sales or use taxes, value-added taxes (VAT), or tariffs.
The payment includes consumption tax and customs duties.
